Question 1

What is an operating lease?

Accepted Answer

An operating lease is a leasing arrangement where the asset does not appear on the lessee's balance sheet. Instead, the lease payments are treated as revenue expenditure — similar to rent. The key distinction is that the risks and rewards of ownership remain with the lessor (the leasing company) rather than transferring to the lessee (your school).

For schools, operating leases are the preferred structure under DfE guidance because they:
• Keep the asset off the school's balance sheet
• Treat payments as revenue expenditure rather than capital
• Do not count against the school's capital budget limits
• Are simpler to account for and report

For a lease to qualify as an operating lease, it must meet certain criteria — the lease term should not cover the majority of the asset's useful economic life, and the present value of lease payments should not equal substantially all of the asset's fair value. Utility Rentals structures all leases to meet these criteria.

Question 2

What is a finance lease?

Accepted Answer

A finance lease (also called a capital lease) transfers substantially all the risks and rewards of ownership to the lessee. Under a finance lease, the asset appears on the lessee's balance sheet as a fixed asset, with a corresponding liability for the outstanding lease payments.

Finance leases are characterised by:
• The lease term covering most of the asset's useful life
• The present value of lease payments equalling substantially all of the asset's fair value
• An option for the lessee to purchase the asset at end of lease for a nominal sum

For maintained schools, finance leases can be more complex to administer and typically require specific approval from the Local Authority. For academy trusts, finance leases above certain thresholds require ESFA approval.

In some circumstances, a finance lease may be the most appropriate structure — particularly for longer-lived assets where the school intends to retain the equipment long-term. Utility Rentals can advise on whether a finance lease or operating lease is more appropriate for your specific requirements.

Question 3

What changed with DfE guidance on leasing?

Accepted Answer

The Department for Education has updated its leasing guidance for maintained schools several times since it was first published. The most significant changes have related to:

Financial thresholds: The DfE has updated the thresholds above which governing bodies must take additional steps (such as seeking Local Authority advice) before entering into a lease.

Operating vs finance lease distinction: The DfE has clarified the distinction between operating leases (acceptable for schools without LA approval in most cases) and finance leases (which require more careful consideration and potentially LA involvement).

Transparency requirements: Schools are now expected to keep clear records of all leasing commitments and ensure these are reflected appropriately in financial returns.

Academy guidance: The Education and Skills Funding Agency (ESFA) has issued separate and evolving guidance for academy trusts and MATs, with specific approval thresholds and reporting requirements.

Utility Rentals has operated in compliance with DfE guidance throughout all changes — and in most cases, our lease structures were already consistent with the principles the DfE would later formalise. We monitor guidance updates continuously and ensure all new leases meet current requirements.

Question 4

Can state schools lease equipment?

Accepted Answer

Yes, maintained state schools can lease equipment. The DfE guidance explicitly permits leasing as a procurement route for schools, subject to certain conditions:

Operating leases are the preferred approach. These keep the asset off the balance sheet and treat payments as revenue expenditure. Schools can enter into operating leases without Local Authority approval in most cases, provided the lease is properly structured and within the school's budget.

Finance leases are also permitted but require more care. Above certain value thresholds, the governing body may need to involve the Local Authority before proceeding.

Key requirements for state school leasing:
• The lease must be an operating lease (in most cases)
• The governing body must formally approve the lease
• The school must be able to afford the ongoing lease payments within its budget
• The lease must represent value for money
• Appropriate records must be kept

Utility Rentals is experienced in working with maintained schools and understands the governance requirements. We can provide all the documentation needed for your governing body approval process.

Question 5

Can academies and MATs lease equipment?

Accepted Answer

Yes, academy trusts and multi-academy trusts can lease equipment. The Education and Skills Funding Agency (ESFA) sets out specific guidance for academies on leasing, which differs in some respects from the DfE guidance for maintained schools.

Key points for academy trusts:

Operating leases: Academies can enter into operating leases. The ESFA expects trusts to ensure leases represent value for money and that the lease structure is appropriate for the asset.

Finance leases: Finance leases above certain thresholds require ESFA prior approval. The ESFA has in recent years increased scrutiny of finance lease arrangements, particularly where they might be used to circumvent capital controls.

Approval thresholds: The ESFA sets out financial thresholds in the Academies Financial Handbook. Leasing commitments above certain levels require Trust Board approval, and in some cases ESFA notification.

MAT-level arrangements: Multi-academy trusts can enter into single lease arrangements covering multiple schools, which can simplify administration and potentially improve terms.

Utility Rentals works with academy trusts of all sizes, from single academies to large MATs. We understand the ESFA framework and can structure leases that meet the Academies Financial Handbook requirements.

Question 6

What is IFRS16 and how does it affect school leases?

Accepted Answer

IFRS 16 (International Financial Reporting Standard 16) is an accounting standard that changed how leases are recognised in financial statements. It came into effect for accounting periods beginning on or after 1 January 2019.

Under IFRS 16, the traditional distinction between operating leases (off balance sheet) and finance leases (on balance sheet) was largely eliminated for lessees. All leases above a de minimis threshold are required to be recognised on the balance sheet as a 'right-of-use asset' and corresponding liability.

How this affects schools:

Maintained schools: Most maintained schools follow the CIPFA Code of Practice for Local Authority Accounting, rather than IFRS directly. The application of IFRS 16 to maintained schools has been subject to specific guidance from CIPFA and the DfE. In practice, the DfE has confirmed that its existing guidance on operating leases remains relevant and that schools should continue to follow DfE guidance rather than applying IFRS 16 directly.

Academy trusts: Academies produce accounts under the Charities SORP, which is based on FRS 102 (UK GAAP) rather than IFRS. The equivalent of IFRS 16 in FRS 102 is Section 20 (Leases), which still distinguishes between operating and finance leases on the basis of the transfer of risks and rewards.

In practice, the operating vs finance lease distinction remains relevant for academy trusts, and Utility Rentals structures all leases to be operating leases under FRS 102 Section 20 where possible.

We recommend discussing the accounting treatment of any proposed lease with your auditors before proceeding, particularly for larger or more complex arrangements. We are happy to liaise with your auditors directly if that would be helpful.

Question 7

Why use Utility Rentals instead of a broker?

Accepted Answer

Most companies offering leasing to schools are brokers. They take your requirements, pass them to a bank or finance house, and earn a commission on the transaction. While this can work, it comes with significant disadvantages:

A broker is not the funder. When you sign a lease with a broker-introduced arrangement, your contract is with the bank — not the broker. The broker may no longer be involved in any meaningful way after the deal is done.

A broker is not the supplier. Brokers source equipment from third-party suppliers. If there's a problem with the equipment, you're dealing with the supplier separately from the finance company — with no single point of accountability.

Brokers add cost. The broker's commission is built into the lease cost. You're paying for an additional layer of overhead.

Utility Rentals is different because:
• We are the funder. We make our own credit decisions from our own balance sheet.
• We are also the supplier. We source and supply the equipment directly.
• One relationship. One contract. One point of contact for the duration of the lease.
• No middleman margin. Our costs are lower because we don't pay commission.
• Faster decisions. No bank committee. No broker delays.

This model has served UK schools since 1985. It works because education is a specialist sector that benefits from a partner who understands it deeply — not a generalist finance broker.

Question 8

What equipment can be leased?

Accepted Answer

Utility Rentals leases a wide range of equipment to UK schools, including:

Technology equipment:
• Laptops (Windows, MacBook, Chromebook)
• iPads and Apple devices
• Desktops and all-in-one computers
• Tablets (Android, Windows)
• Chromebooks
• Interactive flat panel displays (SMART, Promethean, Clevertouch, ViewSonic)
• Printers, projectors, and AV equipment

Vocational and specialist equipment:
• Cookers and food technology equipment
• White goods (washing machines, dishwashers, fridges)
• Sewing machines and textiles equipment

Buildings and structures:
• Temporary and modular classrooms
• Outdoor shelters and canopies

If you need equipment that isn't listed here, please contact us — our experience covers a very wide range of school equipment categories. If it can be leased compliantly, we can structure it.

There is no standard minimum order value, but we typically work with lease values of £5,000 and above.

Question 9

How long are lease terms?

Accepted Answer

Lease terms at Utility Rentals are typically between 3 and 7 years, with the most common terms being:

3 years: Common for fast-moving technology (laptops, tablets, Chromebooks) where hardware becomes outdated more quickly.

4 years: A common term for mid-range technology and some equipment categories.

5 years: Popular for interactive screens, vocational equipment, and white goods where the useful life is longer.

7 years: Sometimes used for temporary classrooms and outdoor shelters where the structure has a longer useful life.

The lease term should reflect the expected useful economic life of the equipment. Structuring a lease over too long a period can create problems with the operating lease definition — if the lease term covers the majority of the asset's useful life, it may be considered a finance lease rather than an operating lease.

We always discuss the appropriate lease term for your specific equipment and requirements, and ensure the structure meets the operating lease definition under DfE guidance.

Question 10

What happens at the end of a lease?

Accepted Answer

At the end of a lease term, there are typically three options:

1. Return the equipment
The most common outcome for technology leases. We arrange collection of the equipment, data destruction if required (for IT equipment), and responsible disposal or refurbishment. There is no further cost to the school beyond ensuring the equipment is available for collection in reasonable condition.

2. Upgrade and re-lease
Many schools choose to upgrade to current technology at the end of the lease term and enter into a new lease for the replacement equipment. This is often the most cost-effective approach for fast-moving technology categories like laptops and interactive screens, as it ensures the school always has current hardware.

3. Negotiate an extension
In some cases, schools may wish to continue using the equipment beyond the initial lease term. We can usually offer a lease extension (often called a secondary period) at a significantly reduced rate, as the residual value has reduced. This can be a cost-effective option if the equipment is still performing well.

We will contact you well in advance of your lease end date (typically 6 months) to discuss your preferences and ensure a smooth transition. We never rely on your forgetting the end date and automatically rolling the lease — our approach is always transparent and proactive.

Question 11

Is there a minimum order value?

Accepted Answer

There is no absolute minimum order value at Utility Rentals, but in practice, leasing is most cost-effective for transactions of £5,000 and above. Below this level, the administrative costs of structuring and documenting a lease can make the arrangement uneconomical compared to simply purchasing the equipment.

Typical order values we work with range from:
• £5,000-£25,000: Single-category, small-scale leases (e.g., a class set of tablets, a set of food technology cookers)
• £25,000-£100,000: Mid-scale programmes (e.g., a computer suite refresh, a classroom screen programme)
• £100,000+: Large-scale programmes (e.g., whole-school 1-to-1 device deployments, multi-site interactive screen rollouts)

We are not a high-volume, low-value broker model. We prefer to work on fewer, larger, well-structured relationships where we can add genuine value and ensure full compliance. If your requirement is below £5,000, we will always tell you honestly if leasing is the right approach rather than pushing you into an arrangement that doesn't make sense.

Contact us to discuss your requirements and we'll give you an honest assessment of whether leasing is the right option for your situation.

Question 12

Can UK maintained schools enter into finance leases under current rules?

Accepted Answer

Yes. Following the implementation of the IFRS 16 Maintained Schools Finance Lease Class Consent guidance by the Department for Education (DfE), maintained schools can now enter into specific finance lease agreements without individual prior Secretary of State approval, provided the lease aligns with approved asset groups such as ICT equipment, functional white goods, or temporary modular learning spaces.

This Class Consent pathway simplifies the process for schools that need a finance lease structure — for example, where an asset's useful life means an operating lease structure is not appropriate. Schools using this route still need to ensure the arrangement is approved by their governing body and properly documented in their financial returns.

In the majority of cases, Utility Rentals structures leases as operating leases, which do not require Class Consent and are simpler to administer. We can advise on the most appropriate structure for your specific equipment and circumstances.

Question 13

What is a self-financed leasing company, and why does it matter?

Accepted Answer

A self-financed leasing company funds its leases directly from its own balance sheet, rather than acting as an intermediary between the school and a bank.

Most companies offering leasing to schools are brokers or introducers. They package your application and pass it to an external finance house or bank, earning a commission in the process. Your contract ends up being with that third party — not the company you originally dealt with.

Utility Rentals is different. We make our own credit decisions and fund all leases directly. This matters because:

• One contract, one relationship. You are dealing with us throughout the full lease term — not a bank you've never met.
• No broker commission. Our cost structure is simpler, which feeds through to more competitive lease rates.
• Faster decisions. There is no bank credit committee to wait for. We can move quickly when a school has a time-sensitive procurement need.
• Genuine accountability. If there is ever an issue with your lease, you deal with us — the funder and the supplier — directly.

This self-financed model has been at the core of how Utility Rentals has operated since 1985.

Question 14

How does Utility Rentals ensure its leases remain DfE and ESFA compliant?

Accepted Answer

Every lease Utility Rentals structures is designed from the outset to comply with the relevant regulatory framework — whether that is DfE guidance for maintained schools, the ESFA Academies Financial Handbook for academy trusts, or specific consent requirements for particular asset classes.

We monitor guidance updates from the DfE, ESFA, and CIPFA on an ongoing basis. In many cases, our lease structures were already consistent with principles the DfE would later formalise in its guidance — because those principles reflect sound financial practice that we have always applied.

Specific steps we take to ensure compliance:
• All leases are structured as operating leases under FRS 102 Section 20 where the asset's useful life allows, keeping assets off the school's balance sheet and payments as revenue expenditure.
• Where a finance lease is more appropriate, we follow the applicable Class Consent or approval pathway.
• We provide governing bodies and trust boards with the documentation they need to complete their formal approval process — including lease summaries, compliance statements, and term sheets.
• We are transparent about what our leases are and how they are structured. We do not use complex arrangements designed to obscure the nature of the commitment.

We recommend that schools discuss any significant lease arrangement with their finance team and, where appropriate, their auditors. We are happy to liaise directly with your advisers if that would be helpful.
